Basic information on the processing of personal data and contacts

Nutritionpro s.r.o., with its registered office at Inovační 122, 252 41 Zlatníky-Hodkovice, ID No. 07752971, e-mail: info@nutritionpro.cz, tel: +420 777 510 839 (hereinafter referred to as the “Operator”), in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: “GDPR”), adheres to the principles of personal data protection and processes only those personal data that serve to provide the service selected by the customer and for the period necessary for this purpose.

The Operator further processes the personal data of customer representatives (contracting parties) as well as potential customers interested in the Operator’s services. The purposes of personal data processing, as well as information on legal titles, legitimate interests, and information regarding the fact that personal information is processed only on the basis of the client’s free and active consent, are always contained in the concluded contract or in the terms and conditions published on the Operator’s website. Personal data is also processed for the purpose of fulfilling the Operator’s legal obligations arising from the Tax Code or other statutory legal regulations, as well as for other purposes that pursue the legitimate interest of the Operator, namely:

1. records of clients who have been contacted by the Operator’s sales representatives in connection with an offer to conclude a contract, or

2. for the purpose of fraud prevention, purposes of monitoring established technological processes,

3. recruitment of new employees who disclose their personal data to the Operator during an interview. Data of unsuccessful candidates are kept for a maximum of 6 months for the purpose of potentially contacting them with another job offer or participation in another or repeated selection procedure for a job position, unless the parties agree otherwise,

4. direct marketing, which refers to the processing of existing customers’ personal data for the purpose of direct contact with a business offer or research. The Operator points out that if a customer objects to direct marketing for a specific service, the Operator will no longer process the customer’s personal data for this purpose, nor will it continue to contact the customer or send business offers,

5. exercise and defense of the Operator’s claims, or

for the purpose of exercising and enforcing legal claims within complaints, litigation, and enforcement of decisions.

The information contained in this document supplements the information provided to customers in the concluded contract.

In all cases of personal information processing by the Operator, the client has the right to object to such processing. The objection is subsequently assessed, and if there are appropriate legal grounds, it will be granted.

All processed personal data are secured by appropriate organizational and technical measures.

Recipients of personal data

A recipient of personal data is a natural or legal person, public authority, agency, or another body to whom the personal data are disclosed, whether a third party or not. Public authorities that may receive personal data in the framework of a particular inquiry in accordance with Member State law shall not be regarded as recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing.

The Operator transfers personal data only to the following recipients who participate in the delivery of goods / services / execution of payments based on a contract, providing marketing services.

The controller does not intend to transfer personal data to a third country (a country outside the EU) or an international organization.

The basic period for which personal data are stored is always specified in the contract concluded between the client and the Operator.

Personal data of potential clients who provided their personal data but did not conclude a contract are stored for a period of 1 year for record-keeping purposes.

For record-keeping purposes, personal data of clients are stored for a period of 10 years from the moment the contract’s effectiveness ends.

Stored data

Contact details: Name, address, telephone number, e-mail address, ID number, because processing is necessary for the performance of a contract to which the data subject is a party, or for the implementation of measures taken prior to the conclusion of the contract at the request of this data subject, or processing is necessary for the purposes of the legitimate interests of the relevant controller or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject requiring the protection of personal data. The purpose is for the Operator to know what the Client requires and for what reason they contacted them.

Location data: Address, postal code, city, state. The reasons and purpose are similar to those stated above for contact details, specifically for delivery purposes.

Communication data: Name, e-mail address, telephone number. The reasons and purpose are similar to those stated above for contact details, specifically so that the Operator can contact the Client for the purpose of performance under the contract, with an appropriate and respectful address, or for the purpose of resolving complications associated with delivery or handling complaints.

Payment data: payment method. The reasons and purpose are similar to those stated above for contact details, specifically for the delivery of orders. Only the data necessary for delivery are passed on to our drivers.

Delivery data: Name, delivery address, telephone number, customer identification number. The reasons and purpose are similar to those stated above for contact details, specifically for the delivery of orders. Only the data necessary for delivery are passed on to our drivers. 

Health data: Our application does not collect, process, or store any health-related data. We do not access any health or fitness information from the user's device or any third-party services.

Other stored data

Any other information and personal data provided by clients about other natural persons with whom they cooperate or whose data are necessary for the fulfillment of the contractual relationship are also stored. The client is obliged to inform these persons in a similar manner about the transfer of their personal data.

Similarly, the Operator collects personal data obtained during telephone calls, or possibly on social networks (Facebook, Twitter, etc.). Telephone calls may be monitored and recorded for the purpose of ensuring the quality and proper functioning of our services. Recordings may be kept for up to six months for internal needs only. The reasons and purpose are similar to those stated above for contact details.

Specific purposes of data processing

Drivers/couriers: Data necessary for the delivery of the order are passed on to these persons, whether they are in an employment or similar relationship, or a third party entrusted with the delivery of the order. The category of personal data is delivery data. Within the meaning of Article 6(1)(b) of the GDPR.

Direct marketing: By providing your email address, you agree to receive our business offers via email. The processing of personal data (telephone numbers, e-mail addresses, etc.) of customers for direct marketing purposes (when sending business communications) is processing carried out for the reason of legitimate interest according to Article 6(1)(f) of the GDPR. We hereby inform our clients of their right to object under Article 21(2) of the GDPR against the processing of personal data for direct marketing purposes. If the Client raises this objection, the personal data may no longer be processed for this purpose (the so-called opt-out principle), see below, withdrawal of consent. The categories of personal data are contact details and location data. If the client does not agree from the beginning with the sending of business communications, emails, etc. above, within direct marketing, they should communicate this request to the Operator within their first order, or send this communication in advance to the email address below, see withdrawal of consent.

Targeting. Targeting refers to customization, i.e., deactivating, activating, and modulating advertising banners on websites for specific target groups for the most effective communication to the website user/potential customer on an individualized basis.

Retargeting. Retargeting refers to the use of cookies in the event of a return visit to the Operator’s website. This function can also be deactivated by deactivating add-ons in your web browser, or restricted or deactivated by deleting cookies. The category of personal data is contact details.

Your next visit can thus be easier for you and the website will be more useful.
